This Act amends the Rail Safety National Law to clarify when a rail safety worker will be taken to be ‘carrying out rail safety work’ for the purposes of prosecuting alcohol and drug offences. This change was agreed to by Australian infrastructure and transport ministers in March 2021. As South Australia is the lead legislator for the National Law, this will apply in all jurisdictions.
